What happens if I lose my Title Deed or it gets damaged?

If your Title Deed is lost, destroyed, or becomes unreadable, you must apply for a Replacement Title. This involves filing a police abstract, publishing a formal “Notice of Loss” in the Kenya Gazette, and waiting 60 days to ensure no one objects. We manage this entire process—from the gazettement to the Land Registry application—to ensure your ownership remains secure and documented.

Legally, no. You cannot validly transfer or sell land belonging to a deceased person until the court issues a Grant of Representation and it is later “confirmed.” Attempting to sell “ancestral land” without these documents often leads to “land grabbing” claims or stalled transactions. We help families obtain these court orders so that property can be sold or shared legally and peacefully.

Under the Land Act, if you are selling or charging (mortgaging) land that serves as a family home, you must get written consent from your spouse. If a sale happens without this consent, the spouse can go to court to stop the transfer or cancel the deal. The process usually begins with a formal Letter of Demand, giving the debtor a specific window (usually 7–14 days) to pay. If they fail to comply, you can file a claim in the Small Claims Court (for amounts up to KES 1 Million) or the Civil Courts. We specialize in fast-tracking debt recovery through both litigation and out-of-court settlements to protect your cash flow.

For a Kenyan company to make major decisions—like taking a loan, selling an asset, or changing directors—it must pass a formal resolution. This document must be signed by the directors and, in many cases, filed with the Registrar of Companies via the e-Citizen portal. We act as Company Secretaries to ensure your board’s decisions are legally binding and follow the Companies Act 2015.

Yes. In Kenya, a Will can be contested if there is proof that the person was pressured (undue influence), was not of sound mind, or if they failed to provide for “dependants” as required by the Law of Succession Act.
